Cybersecurity is a big issue these days.  Data breaches occur all the time.  Because patient data is extremely valuable to criminals, breaches in medical offices are occurring with alarming frequency.  You have heard about the large breaches involving the Anthem and Blue Cross, but there are many, many smaller breaches that don’t make the news.  However, associated with every breach are a lot of lost dollars and time for any practice that must deal with one.  The increased frequency of breaches has also caused the federal government, through many different agencies (CMS, HHS, OIG), to step up HIPAA enforcement.  This increased enforcement comes in many forms – proactive audits, Meaningful Use payment audits, breach and complaint investigations and others.  While practices have always had to comply with HIPAA, proactive government enforcement has been lax.  The landscape has now changed due to the epidemic of breaches we are currently seeing.  We don’t expect this to change anytime soon.  If anything, we see increased enforcement of HIPAA occurring in the future as more government payments are tied to value-based care and EHRs.
